The Pennsylvania Supreme Court during the last few years has taken a more active role in reviewing land use cases.  2003 saw the Pennsylvania Supreme Court hand down several decisions, coinciding as well with Justice William Lamb’s tenure on the Court.  Three of the Supreme Court’s important decisions were authored by Justice Lamb during the final months of his tenure and these three decisions will be the subject of this Article.  It is fair to say that while Justice Lamb’s tenure on the Court was brief, his insight into land use issues as reflected in these three cases is clear evidence that  he well served the citizens of the Commonwealth of Pennsylvania during his term on the Court.

Dewey & Kaye was asked to study the potential for greater collaboration among local land trusts and conservation groups in Allegheny County, Pennsylvania. Nine local organizations, ranging from all-volunteer local land trusts to a regional-scale organization, participated. A steering committee, comprised of representatives from four participating land trusts, worked with Dewey & Kaye to plan and coordinate the project.

It is vital that every land trust consider what will happen to its assets if the organization ceases to exist or can no longer steward or administer its easements. Land trusts should have a contingency plan for all of their easements in case of such events. One strategy is to include backup or contingency provisions in the easement. While there are variations on this practice, a backup or “executory” interest grantee is usually empowered to enforce an easement if the original grantee fails to do so, or to take over an easement if the original grantee can no longer manage it.

The purchase of development rights to farmland and open space has recently gained in popularity as a growth management tool. A purchase of development rights program pays the landowner for the unearned increment in exchange for strong deed restrictions, limiting the use of the property. On the other hand, land value taxation, a modification of Henry George's Single Tax, would tax land more heavily than improvements, thus encouraging the development of land. While land value taxation and the purchase of development rights appear to be opposing fiscal policies, they could be employed together as part of a regional planning strategy to encourage in-fill development within and near cities and to curb sprawl by retaining farm, forest, and ranch lands.

This paper presents the results from a land use and community service study conducted in Walker Township (Centre County), which investigated the relationship between land uses and local government expenditures and revenues.  It compares the local government and school district revenues provided by different land uses with the cost of providing services to those land uses. The study followed the methodology of similar studies by the American Farmland Trust.  Four land uses were considered: Residential land, Industrial land, Commercial land, and Agricultural land.  The definitions follow Pennsylvania tax assessment conventions, with one exception.  The buildings and homes on farms (the homestead) were treated as residential properties.  Land without buildings on farms was categorized as Agricultural land.  This was done to make the study consistent with the earlier American Farmland Trust studies.

The following pages outline strategies and corresponding activities to be taken in 2007 to promote each of these goals.  The plan identifies responsible parties for each task.  This plan will be the source of annual workplans for each committee and staff member of the Conservancy.  The plan will be reviewed at year end, using the “Results” field, to assess our performance, to guide us in assembling the 2008 Annual Plan, and to help us amend and update the Strategic Plan.

This strategic plan is the product of a series of planning sessions held between December,  2005 and February, 2006 and represents the first effort of this kind in the history of Keystone  Trails Association.  These sessions were facilitated by a team of students, under faculty  supervision, from the Nonprofit Clinic, Graduate School of Public and International Affairs,  University of Pittsburgh.  As background information to help guide the planning process, two  documents were initially prepared by the Clinic.  The first document was an Environmental Scan  which consisted of a SWOT (Strengths, Weaknesses, Opportunities, and Threats) analysis of  Keystone Trails Association (KTA).  The second document was an Industry Analysis which  focuses on the competition facing the association from other similar organizations throughout the  United States.  These two documents are included in the Appendices.  The plan includes a newly formulated mission statement and a vision statement, the latter  of which is an articulated expression of the kind of environment relative to hiking which will be  realized in the future if KTA is successful in achieving its mission through the implementation of  this plan.  In developing its strategic plan, KTA identified a number of strategic issues which  were considered important to KTA’s survival and future effectiveness.

It has been twenty-three years since North Carolina enacted the nation’s first
state tax credit program for land conservation donations. Since that time, the

The inequalities in conventional zoning-based policies leave urban-fringe jurisdictions unable to meet the growing demand for permanently preserved open space. Allocating marketable development rights (MDR) among all landowners treats this problem directly. It also leaves open the option of allowing the market to allocate land to undeveloped uses. A simple market model is used to develop a framework that describes the mechanics of such a program; it allows for comparison with other commonly considered policies. Several concerns policy makers have raised about a market in development rights are addressed. Alternative regulatory responses to perceived market failures are presented. It is suggested that and MDR program offers significant advantages over existing preservation efforts.
